Boy Scouts' opposition to background checks let pedophiles in









Amid reports of widespread sexual abuse of children in the late 1980s, several leading youth organizations began conducting criminal background checks of volunteers and staff members.


Big Brothers Big Sisters ordered the checks for all volunteers starting in 1986. Boys and Girls Clubs of America recommended their use the same year.


One of the nation's oldest and largest youth groups, however, was opposed — the Boy Scouts of America.

Scouting officials argued that background checks would cost too much, scare away volunteers and provide a false sense of security. They successfully lobbied to kill state legislation that would have mandated FBI fingerprint screening.


While touting their efforts to protect children, the Scouts for years resisted one of the most basic tools for preventing abuse. The result: The organization let in hundreds of men with criminal histories of child molestation, many of whom went on to abuse more children, according to a Times analysis of the Scouts' confidential abuse files.


Scouting did not require criminal background checks for all volunteers until 2008 — despite calls from parents and staff who said its vetting system didn't work.


In 1989, a Scout committee chairman in St. Paul, Minn., decried the organization's "half-hearted" screening in a letter to headquarters.


"BSA is only creating an illusion of performing what they claim," K. Russell Sias wrote to Scout Chief Executive Ben Love. "It becomes quite clear that BSA is more concerned in 'passing the buck' than in accepting responsibility for those who are its adult leaders."


That same year, a Las Vegas scoutmaster with a criminal history of exposing himself to boys was arrested for sexually abusing a 12-year-old Scout. One parent said casinos did a better job of screening workers.


"The black eye which scouting has suffered in this … could easily have been avoided if the council had taken the simple expedient of doing a background investigation," the parent wrote to Scouting officials.


From 1985 to 1991 — when the detailed files obtained by The Times end — the Boy Scouts admitted more than 230 men with previous arrests or convictions for sex crimes against children, the analysis found.


The men were accused of molesting nearly 400 boys while in Scouting. They accounted for one in six of those expelled for alleged abuse during those years.


Scouting officials declined to be interviewed but said in a prepared statement that they have enhanced their policies over the years and tried "to ensure we are in line with and, where possible, ahead of society's knowledge of abuse and best practices for prevention."


"Numerous independent experts have recognized that our programs for protecting Scouts from abuse are among the best in the youth-serving community," it said.


The Scouts' past handling of child sexual abuse has come under increased scrutiny since October, after the court-ordered release of hundreds of confidential files dating back decades. The Times earlier obtained and analyzed a larger and more recent set of files — about 1,900 dossiers opened from 1970 to 1991.


The records, dubbed the "perversion files" by Scouting officials, have been a key tool for nearly a century, intended to keep out men expelled for alleged abuse.


The files also offer a detailed record of the system's failures. The Times reported in August that from 1970 to 1991 dozens of men previously expelled had slipped back into the program, only to be accused of molesting again. The Times later reported that Scouting officials failed to report hundreds of alleged abusers to police and often hid the allegations from parents and the public.


The organization has fought in court to prevent the release of more recent files, making it impossible to determine how many men with criminal histories were caught in the organization after 1991.


Court records and news accounts, however, show that convicted molesters continued to find new victims in Scouting.

NBC sets premiere date for “Do No Harm” drama












LOS ANGELES (TheWrap.com) – NBC will premiere its new drama “Do No Harm” at 10 p.m. on January 31, NBC Entertainment chairman Robert Greenblatt said Friday.


The premiere date takes advantage of the one-hour series finale of “30 Rock,” which will air at 8 p.m. on that same night.












“Do No Harm” stars “Rescue Me” alum Steven Pasquale as Dr. Jason Cole, a neurosurgeon whose life is going swimmingly until his dangerous alter-ego emerges, hell-bent on creating havoc on Cole and those around him.


“January 31 will be a special night as one classic series will mark its finale with a great hour-long send-off episode while a promising new drama will make its debut on Thursdays,” Greenblatt said. “‘30 Rock’ is acclaimed as a legendary comedy and we will see a truly memorable and fitting last episode. In ‘Do No Harm,’ viewers will have a unique new dramatic storyline with an exciting new star in Steven Pasquale that takes them into dark and uncharted territory.”

Unboxed: Stand-Up Desks Gaining Favor in the Workplace


THE health studies that conclude that people should sit less, and get up and move around more, have always struck me as fitting into the “well, duh” category.


But a closer look at the accumulating research on sitting reveals something more intriguing, and disturbing: the health hazards of sitting for long stretches are significant even for people who are quite active when they’re not sitting down. That point was reiterated recently in two studies, published in The British Journal of Sports Medicine and in Diabetologia, a journal of the European Association for the Study of Diabetes.


Suppose you stick to a five-times-a-week gym regimen, as I do, and have put in a lifetime of hard cardio exercise, and have a resting heart rate that’s a significant fraction below the norm. That doesn’t inoculate you, apparently, from the perils of sitting.


The research comes more from observing the health results of people’s behavior than from discovering the biological and genetic triggers that may be associated with extended sitting. Still, scientists have determined that after an hour or more of sitting, the production of enzymes that burn fat in the body declines by as much as 90 percent. Extended sitting, they add, slows the body’s metabolism of glucose and lowers the levels of good (HDL) cholesterol in the blood. Those are risk factors toward developing heart disease and Type 2 diabetes.


“The science is still evolving, but we believe that sitting is harmful in itself,” says Dr. Toni Yancey, a professor of health services at the University of California, Los Angeles.


Yet many of us still spend long hours each day sitting in front of a computer.


The good news is that when creative capitalism is working as it should, problems open the door to opportunity. New knowledge spreads, attitudes shift, consumer demand emerges and companies and entrepreneurs develop new products. That process is under way, addressing what might be called the sitting crisis. The results have been workstations that allow modern information workers to stand, even walk, while toiling at a keyboard.


Dr. Yancey goes further. She has a treadmill desk in the office and works on her recumbent bike at home.


If there is a movement toward ergonomic diversity and upright work in the information age, it will also be a return to the past. Today, the diligent worker tends to be defined as a person who puts in long hours crouched in front of a screen. But in the 19th and early 20th centuries, office workers, like clerks, accountants and managers, mostly stood. Sitting was slacking. And if you stand at work today, you join a distinguished lineage — Leonardo da Vinci, Ben Franklin, Winston Churchill, Vladimir Nabokov and, according to a recent profile in The New York Times, Philip Roth.


DR. JAMES A. LEVINE of the Mayo Clinic is a leading researcher in the field of inactivity studies. When he began his research 15 years ago, he says, it was seen as a novelty.


“But it’s totally mainstream now,” he says. “There’s been an explosion of research in this area, because the health care cost implications are so enormous.”


Steelcase, the big maker of office furniture, has seen a similar trend in the emerging marketplace for adjustable workstations, which allow workers to sit or stand during the day, and for workstations with a treadmill underneath for walking. (Its treadmill model was inspired by Dr. Levine, who built his own and shared his research with Steelcase.)


The company offered its first models of height-adjustable desks in 2004. In the last five years, sales of its lines of adjustable desks and the treadmill desk have surged fivefold, to more than $40 million. Its models for stand-up work range from about $1,600 to more than $4,000 for a desk that includes an actual treadmill. Corporate customers include Chevron, Intel, Allstate, Boeing, Apple and Google.


“It started out very small, but it’s not a niche market anymore,” says Allan Smith, vice president for product marketing at Steelcase.


The Steelcase offerings are the Mercedes-Benzes and Cadillacs of upright workstations, but there are plenty of Chevys as well, especially from small, entrepreneurial companies.


In 2009, Daniel Sharkey was laid off as a plant manager of a tool-and-die factory, after nearly 30 years with the company. A garage tinkerer, Mr. Sharkey had designed his own adjustable desk for standing. On a whim, he called it the kangaroo desk, because “it holds things, and goes up and down.” He says that when he lost his job, his wife, Kathy, told him, “People think that kangaroo thing is pretty neat.”


Today, Mr. Sharkey’s company, Ergo Desktop, employs 16 people at its 8,000-square-foot assembly factory in Celina, Ohio. Sales of its several models, priced from $260 to $600, have quadrupled in the last year, and it now ships tens of thousands of workstations a year.


Steve Bordley of Scottsdale, Ariz., also designed a solution for himself that became a full-time business. After a leg injury left him unable to run, he gained weight. So he fixed up a desktop that could be mounted on a treadmill he already owned. He walked slowly on the treadmill while making phone calls and working on a computer. In six weeks, Mr. Bordley says, he lost 25 pounds and his nagging back pain vanished.


He quit the commercial real estate business and founded TrekDesk in 2007. He began shipping his desk the next year. (The treadmill must be supplied by the user.) Sales have grown tenfold from 2008, with several thousand of the desks, priced at $479, now sold annually.


“It’s gone from being treated as a laughingstock to a product that many people find genuinely interesting,” Mr. Bordley says.


There is also a growing collection of do-it-yourself solutions for stand-up work. Many are posted on Web sites like howtogeek.com, and freely shared like recipes. For example, Colin Nederkoorn, chief executive of an e-mail marketing start-up, Customer.io, has posted one such design on his blog. Such setups can cost as little as $30 or even less, if cobbled together with available materials.


UPRIGHT workstations were hailed recently by no less a trend spotter of modern work habits and gadgetry than Wired magazine. In its October issue, it chose “Get a Standing Desk” as one of its “18 Data-Driven Ways to Be Happier, Healthier and Even a Little Smarter.”


The magazine has kept tabs on the evolving standing-desk research and marketplace, and several staff members have become converts themselves in the last few months.


“And we’re all universally happy about it,” Thomas Goetz, Wired’s executive editor, wrote in an e-mail — sent from his new standing desk.

L.A. County seeing high-risk offenders entering its probation system









One year into California's state prison realignment program, Los Angeles County is seeing an unexpected number of high-risk offenders coming into its probation system, including some with a history of severe mental illness.


It remains unclear whether realignment — which shifted responsibility for some nonviolent offenders from prisons to county jails and from state parole to county probation — is having an effect on crime rates. But a report by a county advisory body found that a majority of state prison inmates who have been released to county probation are at a high risk of reoffending.


In the first year of the new system, which took effect in October 2011, 11,136 offenders were released from state prison to Los Angeles County probation. Of those who reported to probation for assessment, 59% were classed as high risk, 40% as medium risk and only 1% as low risk.





The department uses probationers' criminal history and other factors to determine the risk that they will commit new crimes and the resources required to supervise them.


Deputy Chief Reaver Bingham said the department originally projected that 50% of the offenders coming out of state prison would fall into the high-risk category.


And a handful of people previously classified as mentally disordered offenders — people considered dangerous because of mental illness — were downgraded or "decertified" while in state hospitals, making them eligible for county supervision, according to the report issued Thursday by the Countywide Criminal Justice Coordination Committee.


County officials said that runs contrary to the spirit of realignment, which was pitched as a money-saving measure for the state that would transfer low-level offenders to less costly county supervision. The committee's report said the decertified mentally disordered offenders "present high public safety risk, present significant placement issues, and consume high levels of resources."


Jeffrey Callison, a spokesman with the state corrections department, said the courts, not the department, determine who is decertified and that under the current law, people not classified as mentally disordered who are eligible for realignment are required to go to county supervision.


"It's not for me to say that a given county does or doesn't have the resources to supervise a person who has been decertified," he said.


The committee's report recommended that the county seek legislation to shift back to the state responsibility for probationers formerly designated as mentally disordered offenders as well as "medically fragile" people and prisoners serving long sentences in county jail.

Only in Vegas: Sprinting Santas and Run-Through Weddings











LAS VEGAS — Only in Sin City would the sight of 8,000 Santas running amok through the streets not raise an eyebrow. Even the Elvis Santas barely drew second glances in this town, where the King is as common as bad buffets and bad judgment.



But such things are par for the course when you’re running in a city where everything is just a bit more … weird, including the sports. The insanity returns this weekend with a zany fitness double feature that brings the 8th annual Great Santa Run and the Rock n’ Roll Las Vegas Marathon to town.


Part of what makes the Santa fun run so, well, fun, is everyone gets a brand-new five-piece Santa suit. I caught the action a few years back and seeing these photos still makes me smile.


As silly as that is — and it’s pretty freakin’ silly — it’s but a warmup to the Rock n’ Roll marathon. These things are held in cities around the world and they’re always lots of fun — well, fun if you’re capable of running 26.2 miles without dying — but the Vegas version is just a bit more so.


It isn’t the 40,000 people running down Las Vegas boulevard, or the live music, or even the celebrity impersonators — is that Celine Dion? — huffing and puffing down the Strip.


No, what makes this a distinctly Vegas experience is the run-through wedding service. That’s right. You and your dearly beloved can take a brief detour from the course and get hitched outside the Paris Las Vegas hotel and casino. Talk about an endurance race.


I’m still awaiting the addition of a run-through divorce court. Maybe next year.

“iCarly” and “Victorious” spinoff gets greenlight from Nickelodeon

Nickelodeon has greenlit “Sam & Cat,” a hybrid spinoff of “iCarly” – which ended its run last week – and the Nickelodeon seriesVictorious.”

The 20-episode first season of “Sam & Cat” will premiere next year; production will begin in January in Los Angeles.

Hockey Coaches Defy Doctors on Concussions, Study Finds





Despite several years of intensive research, coverage and discussion about the dangers of concussions, the idea of playing through head injuries is so deeply rooted in hockey culture that two university teams kept concussed players on the ice even though they were taking part in a major concussion study.




The study, which was published Friday in a series of articles in the journal Neurosurgical Focus, was conducted during the 2011-12 hockey season by researchers from the University of Western Ontario, the University of Montreal, Harvard and other institutions.


“This culture is entrenched at all levels of hockey, from peewee to university,” said Dr. Paul S. Echlin, a concussion specialist and researcher in Burlington, Ontario, and the lead author of the study. “Concussion is a significant public health issue that requires a generational shift. As with smoking or seat belts, it doesn’t just happen overnight — it takes a massive effort and collective movement.”


The study is believed to be among the most comprehensive analyses of concussions in hockey, which has a rate of head trauma approaching that of football. Researchers followed two Canadian university teams — a men’s team and a women’s team — and scanned every player’s brain before and after the season. Players who sustained head injuries also received scans at three intervals after the injuries, with researchers using advanced magnetic resonance imaging techniques.


The teams were not named in the study, in which an independent specialist physician was present at each game and was empowered to pull any player off the ice for examination if a potential concussion was observed.


The men’s team, with 25 players and an average age of 22, played a 28-game regular season and a 3-game postseason. The women’s team, with 20 players and an average age of 20, played 24 regular-season games and no playoff games. Over the course of the season, there were five observed or self-reported concussions on the men’s team and six on the women’s team.


Researchers noted several instances of coaches, trainers and players avoiding examinations, ignoring medical advice or otherwise obstructing the study, even though the players had signed consent forms to participate and university ethics officials had given institutional consent.


“Unless something is broken, I want them out playing,” one coach said, according to the study.


In one incident, a neurologist observing the men’s team pulled a defenseman during the first period of a game after the player took two hits and was skating slowly. During the intermission the player reported dizziness and was advised to sit out, but the coach suggested he play the second period and “skate it off.” The defenseman stumbled through the rest of the game.


“At the end of the third period, I spoke with the player and the trainer and said that he should not play until he was formally evaluated and underwent the formal return-to-play protocol,” the neurologist said, as reported in the study. “I was dismayed to see that he played the next evening.”


After the team returned from its trip, the neurologist questioned the trainer about overruling his advice and placing the defenseman at risk.


“The trainer responded that he and the player did not understand the decision and that most of the team did not trust the neurologist,” according to the study. “He requested that the physician no longer be used to cover any more games.”


In another episode, a physician observer assessed a minor concussion in a female player and recommended that she miss the next night’s game. Even though the coach’s own playing career had ended because of concussions, she overrode the medical advice and inserted the player the next evening.


According to the report, the coach refused to speak to another physician observer on the second evening. The trainer was reluctant to press the issue with the coach because, the trainer said, the coach did not want the study to interfere with the team.

Prop. 8 supporters, opponents await Supreme Court decision









At San Francisco City Hall, officials are awaiting their moment in history, but they just don't know when it will come.


In the complex calculus of gay marriage in California, weddings could become legal within days. So City Hall is preparing for a possible crush of same-sex couples seeking marriage licenses and making contingency plans for demonstrations.


But it is also possible that this preparation is for naught and the future of same-sex unions will remain up in the air for months or longer.





CHRONOLOGY: Gay marriage in the U.S.


The U.S. Supreme Court is poised to take up the issue of gay marriage in California as soon as Friday morning. The moment has prompted nervous debate within the gay-rights movement about the best path to achieve gay marriage.


If the justices opt not to hear the Proposition 8 case, then a federal appeals court ruling that found the 2008 state ballot measure banning same-sex marriage unconstitutional would stand, clearing the way for marriages to begin. If the justices take up the case, a ruling would not come until next year and gay marriage would remain on hold until then, or longer depending on how the court rules.


Were the high court to decide to rule on Hollingsworth vs. Perry, it could lead to a historic victory legalizing same-sex marriage nationwide. But gay activists are well aware that the court could rule against them and throw the movement back at a time when same-sex marriage has seen a series of election victories at the state level.


Opponents of gay marriage, by contrast, are eager for the Supreme Court to weigh in and are hoping it will block the growing legalization of same-sex unions.


"This claim that somehow hidden within the U.S. Constitution is this right to redefine marriage is just false," said Brian Brown, the president of the National Organization for Marriage.


Jim Campbell, legal counsel for Alliance Defending Freedom, which represents the official proponents of Proposition 8, agreed, and said he hoped the high court would conclude "that defining marriage as the union of a man and a woman is constitutional."


It's been four years since California voters approved a ban on gay marriage. During that time, several more states have legalized gay marriage; it is now legal in nine states and the District of Columbia. Many gay-rights activists in California feel left behind and eager for the state to resume marriages. The question is: How best to make it happen?


Jeffrey J. Zarrillo, who with his partner is a plaintiff in the federal suit now before the court, wants the high court to hear the case, which he is confident of winning. "This case is important in all 50 states, not just California," said Zarrillo, 39, a Burbank resident.


TIMELINE: Gay marriage since 2000


But Kate Kendell, executive director of the National Center for Lesbian Rights, is one of the voices of caution. "Anything is possible with any court," she warned, and legal scholars don't give a win in the case "the best odds."


For that reason, Kendell said she hopes the court doesn't take the case. That would still "put a grave marker on top of Proposition 8 once and for all and allow California couples to marry." Recent studies from the Williams Institute at UCLA law school, a think tank on sexual orientation policy, found that there are nearly 100,000 same-sex couples living in California, and that 24,000 would marry in the next three years if they had the opportunity to do so.


The long years of litigation also have left some gays and lesbians impatient and frustrated and questioning whether the courts remain their best forum for achieving marriage equality. Given the victories on election night, some believe that the ballot box, not the legal system, may now be the answer.


"There are definitely divisions in terms of people's views," said Gary Gates, a researcher at the Williams Institute. Some "say if this case hadn't come up, and we had put it on the ballot … we might have had marriage back."


The divergence of opinion echoes back to the days when the historic federal lawsuit was first filed in 2009. At the time, many gay-rights groups opposed going into federal court, fearing a setback at the U.S. Supreme Court. They preferred to tackle marriage rights state by state.

But with voters passing marriage bans across the country, a political strategist in Los Angeles, Chad Griffin, hired a top-notch legal team to sue to overturn Proposition 8 in federal district court in San Francisco. New Camera Snaps All-Sky Auroras in Full Color











Capturing a multicolored, all-sky image of the auroras that decorate Earth’s polar skies is now possible.


Normally, studying these shimmering phenomena means taking multiple images of an aurora, using different filters that block or image different wavelengths. Now, a camera with tunable liquid crystal filters can capture many colors at once, a team of space-weather researchers reports Nov. 29 in Optics Express.


Called NORUSCA II, the camera also takes pictures of the entire sky. Scientists are hoping that such precision aurora-imaging will help them better understand and classify the celestial light shows.


The team tested the sky-gazing camera at the Kjell Henriksen Observatory in Svalbard, Norway, during the auroral season of 2011 and 2012. On Jan. 24, 2012, an enormous solar flare flung a blob of charged particles in Earth’s direction. The skies over Svalbard lit up as the particles struck Earth’s atmosphere, producing a bright green aurora and intense geomagnetic storm.



Charged particles colliding with different gases in Earth’s atmosphere produce the multicolored auroras. For example, oxygen atoms can glow green or red, depending on their altitude. Hydrogen and helium high in the ionosphere can produce shimmering blue or purple. Nitrogen? Red, violet, or blue.


The new camera captured these swirling lights using many different wavelength channels; individual frames from the Jan. 24 event have been stitched together in the video above. And the camera is sensitive enough to see daytime auroras, like the reddish lights flickering across the sky on Dec. 29, 2011 (video below).

Actor who apparently killed landlady not on drugs












LOS ANGELES (AP) — An autopsy report shows no drugs were detected in the body of a former “Sons of Anarchy” actor who police say killed his landlady and then fell to his death.


Toxicology results on Johnny Lewis found no traces of cocaine, alcohol, marijuana or any other types of drugs in the actor’s system. Officials checked for anti-psychotic drugs as well as psychedelic drugs.












Lewis was found dead in September in the driveway of a Los Angeles residence, and police found his landlady and a cat dead inside the home. Officials believe Lewis fell while trying to flee the home after killing 81-year-old Catherine Davis.


The killing occurred just days after Lewis was released from jail. Records show he had pleaded no contest to assault with a deadly weapon and attempted burglary in separate cases.


Authorities expressed concern about his mental health in court hearings before his release.

Clearing the Fog Around Personality Disorders





For years they have lived as orphans and outliers, a colony of misfit characters on their own island: the bizarre one and the needy one, the untrusting and the crooked, the grandiose and the cowardly.




Their customs and rituals are as captivating as any tribe’s, and at least as mystifying. Every mental anthropologist who has visited their world seems to walk away with a different story, a new model to explain those strange behaviors.


This weekend the Board of Trustees of the American Psychiatric Association will vote on whether to adopt a new diagnostic system for some of the most serious, and striking, syndromes in medicine: personality disorders.


Personality disorders occupy a troublesome niche in psychiatry. The 10 recognized syndromes are fairly well represented on the self-help shelves of bookstores and include such well-known types as narcissistic personality disorder, avoidant personality disorder, as well as dependent and histrionic personalities.


But when full-blown, the disorders are difficult to characterize and treat, and doctors seldom do careful evaluations, missing or downplaying behavior patterns that underlie problems like depression and anxiety in millions of people.


The new proposal — part of the psychiatric association’s effort of many years to update its influential diagnostic manual — is intended to clarify these diagnoses and better integrate them into clinical practice, to extend and improve treatment. But the effort has run into so much opposition that it will probably be relegated to the back of the manual, if it’s allowed in at all.


Dr. David J. Kupfer, a professor of psychiatry at the University of Pittsburgh and chairman of the task force updating the manual, would not speculate on which way the vote might go: “All I can say is that personality disorders were one of the first things we tackled, but that doesn’t make it the easiest.”


The entire exercise has forced psychiatrists to confront one of the field’s most elementary, yet still unresolved, questions: What, exactly, is a personality problem?


Habits of Thought


It wasn’t supposed to be this difficult.


Personality problems aren’t exactly new or hidden. They play out in Greek mythology, from Narcissus to the sadistic Ares. They percolate through biblical stories of madmen, compulsives and charismatics. They are writ large across the 20th century, with its rogues’ gallery of vainglorious, murderous dictators.


Yet it turns out that producing precise, lasting definitions of extreme behavior patterns is exhausting work. It took more than a decade of observing patients before the German psychiatrist Emil Kraepelin could draw a clear line between psychotic disorders, like schizophrenia, and mood problems, like depression or bipolar disorder.


Likewise, Freud spent years formulating his theories on the origins of neurotic syndromes. And Freudian analysts were largely the ones who, in the early decades of the last century, described people with the sort of “confounded identities” that are now considered personality disorders.


Their problems were not periodic symptoms, like moodiness or panic attacks, but issues rooted in longstanding habits of thought and feeling — in who they were.


“These therapists saw people coming into treatment who looked well put-together on the surface but on the couch became very disorganized, very impaired,” said Mark F. Lenzenweger, a professor of psychology at the State University of New York at Binghamton. “They had problems that were neither psychotic nor neurotic. They represented something else altogether.”


Several prototypes soon began to emerge. “A pedantic sense of order is typical of the compulsive character,” wrote the Freudian analyst Wilhelm Reich in his 1933 book, “Character Analysis,” a groundbreaking text. “In both big and small things, he lives his life according to a preconceived, irrevocable pattern.”


Others coalesced too, most recognizable as extreme forms of everyday types: the narcissist, with his fragile, grandiose self-approval; the dependent, with her smothering clinginess; the histrionic, always in the thick of some drama, desperate to be the center of attention.


In the late 1970s, Ted Millon, scientific director of the Institute for Advanced Studies in Personology and Psychopathology, pulled together the bulk of the work on personality disorders, most of it descriptive, and turned it into a set of 10 standardized types for the American Psychiatric Association’s third diagnostic manual. Published in 1980, it is a best seller among mental health workers worldwide.


These diagnostic criteria held up well for years and led to improved treatments for some people, like those with borderline personality disorder. Borderline is characterized by an extreme neediness and urges to harm oneself, often including thoughts of suicide. Many who seek help for depression also turn out to have borderline patterns, making their mood problems resistant to the usual therapies, like antidepressant drugs.


Today there are several approaches that can relieve borderline symptoms and one that, in numerous studies, has reduced hospitalizations and helped aid recovery: dialectical behavior therapy.


This progress notwithstanding, many in the field began to argue that the diagnostic catalog needed a rewrite. For one thing, some of the categories overlapped, and troubled people often got two or more personality diagnoses. “Personality Disorder-Not Otherwise Specified,” a catchall label meaning little more than “this person has problems” became the most common of the diagnoses.


It’s a murky area, and in recent years many therapists didn’t have the time or training to evaluate personality on top of everything else. The assessment interviews can last hours, and treatments for most of the disorders involve longer-term, specialized talk therapy.


Psychiatry was failing the sort of patients that no other field could possibly help, many experts said.


“The diagnoses simply weren’t being used very much, and there was a real need to make the whole system much more accessible,” Dr. Lenzenweger said.


Resisting Simplification 


It was easier said than done.


The most central, memorable, and knowable element of any person — personality — still defies any consensus.


A team of experts appointed by the psychiatric association has worked for more than five years to find some unifying system of diagnosis for personality problems.


The panel proposed a system based in part on a failure to “develop a coherent sense of self or identity.” Not good enough, some psychiatric theorists said.


Later, the experts tied elements of the disorders to distortions in basic traits.

DealBook: Vinod Khosla Keeps Long-Term Bet on Clean Technology

Vinod Khosla crowed about the clean energy industry last year. Three of the biofuel start-ups in his venture capital portfolio had just gone public, and the stocks had risen considerably after their debuts. “I challenge anybody to claim that clean tech done right is a disaster,” Mr. Khosla said at a conference, rebuffing recent criticism. “We’ve generated more profits there than anybody has.”

Since then, Mr. Khosla, the founder of Khosla Ventures, has watched much of those paper gains evaporate. As the clean energy industry broadly has taken a hit, shares of the biofuel companies — Amyris, Gevo and KiOR — have slumped 70 percent to 90 percent from their peaks. His stakes, once worth as much as $1.3 billion, are now valued at roughly $378 million.

The billionaire investor has been caught in the cyclical downdraft.

The public stocks of solar, wind and biofuel companies are suffering amid industrywide pressures. The price of natural gas remains low. Europe has pulled back on incentives. American subsidies are in question after the bankruptcy of the solar panel maker Solyndra. And China is providing formidable low-cost competition.

“The whole clean tech sector has been out of favor,” said Pavel Molchanov, an analyst at Raymond James & Associates, a brokerage firm. “I’d be hard pressed to name one trading above its I.P.O. price.”

Despite the crosscurrents, Mr. Khosla seems unwavering in his commitment. He is pouring money into start-ups. Khosla Ventures recently invested more in LightSail Energy, a three-year-old start-up working to develop low-cost energy storage. He is also sticking with his public companies. His firm, for example, still owns 54 percent of KiOR.

“He’s a visionary who likes to make big bets on ideas that can really change the world,” said Andy Bechtolsheim, who co-founded Sun Microsystems with Mr. Khosla 30 years ago and shares a house with him at Big Sur on the California coast. “I would think he’s made a larger personal bet on green tech than anybody else.”

While the public markets are raising short-term doubts, the long-term investment thinking remains unchanged. Governments around the globe are pushing to find alternative sources of energy in an effort to reduce their dependence on fossil fuels that may hurt the environment. In a television interview in 2007, Mr. Khosla said “mainstream solutions” could replace up to 80 percent of oil-based power. Without them, he said, “this planet is history the way we know it today.” After Hurricane Sandy, the subject of global warming — and changing climate conditions — has again come to the forefront.

In a recent blog post on the Forbes Web site, Mr. Khosla acknowledged the shift in market sentiment. “Clean tech went through a time when it was in vogue and now it is not,” he wrote. “The financing environment for clean tech companies is tough today,” he added. But he said he still expected “to do better than industry averages by keeping our losing companies to a minority.”

Since founding his venture capital firm in 2004, Mr. Khosla has become one of the most vocal advocates for clean tech innovation, buying stakes in about 60 industry start-ups. Ausra, a solar thermal start-up that had drawn $130 million in venture backing, was sold in 2010 to the French nuclear plant builder Areva for about $250 million, according to one industry estimate. And SeaMicro, a low-power server maker, was bought this year by Advanced Micro Devices for $334 million, more than five times the amount invested by its venture backers, according to a SeaMicro co-founder, Andrew Feldman.

It’s unclear how the broader clean tech portfolio has performed at Khosla Ventures. Mr. Khosla declined to disclose the firm’s returns or to comment for the article.

But one of his funds, which raised $1 billion to invest in clean tech and other start-ups, shows gain of 30 percent since its inception in 2009, according to filings by the California Public Employees’ Retirement System, the largest state pension fund. In his Forbes blog post, Mr. Khosla said a recent fund, which raised $1.05 billion in October 2011, was oversubscribed, and his firm’s broader performance since 2006 had “well exceeded typical venture funds.” In that period, venture funds over all have returned 7.25 percent annually after fees, according to industry data.

Mr. Khosla’s commitment is an outgrowth of his three decades at the cutting edge of technology.

A native of India, Mr. Khosla, 57, earned a master’s degree in biomedical engineering from Carnegie Mellon and an M.B.A. from Stanford in 1980. After starting the design automation company Daisy Systems in 1982, he co-founded Sun Microsystems, then a growing technology company.

At Sun, he supplied drive and vision. But Mr. Khosla, who is known for his blunt talk and intense manner, was replaced as chief executive two years later and left the company shortly thereafter.

In 1986, he joined the venture capital firm Kleiner Perkins Caufield & Byers. Over the next two decades, Mr. Khosla scored sizable returns betting on the growth of fiber optic networks. Two companies, Cerent and Siara Systems, were sold for a combined $15 billion-plus at the height of the late-1990s dot-com bubble.

Mr. Khosla was looking into alternative fuel technologies at Kleiner Perkins when a business plan for an ethanol start-up crossed his desk in 2003. The plan “sat on a corner of my desk for nearly 18 months while I read everything I could about petroleum and its alternatives,” he wrote in an article for Wired magazine in 2006.

When he branched out on his own in 2004, Mr. Khosla invested millions in the ethanol start-up, Celunol. He soon established himself as a top venture capitalist in clean tech, attracting prominent outside investors like Microsoft’s founder, Bill Gates. Former Prime Minister Tony Blair of Britain joined the firm as a senior adviser.

Over the years, Mr. Khosla has experienced his share of blowups.

In September 2011, Khosla-backed Range Fuels, a wood-chips-to-ethanol company, went bankrupt after receiving a $44 million grant from the Department of Energy and $33 million under a Department of Agriculture loan guarantee. When The Wall Street Journal editorial page criticized Range Fuels as an “exercise in corporate welfare,” Mr. Khosla lashed back, saying the authors inhabited an “ivory tower” that was “full of people who don’t understand technology.”

Sometimes, Mr. Khosla’s companies had to pivot from their original plans and focus on new markets. For example, Calera was founded in 2007 with plans to use power plant exhaust to make cement. Mr. Khosla called its technology “game changing” in 2008.

But the company encountered some setbacks. It postponed plans for commercial-scale production in 2010 pending further research and later cut its 145-employee work force by two-thirds. Since then, Calera has broadened its focus, developing other products like fillers for paper and plastics.

Like many venture capital investors, Mr. Khosla will risk a few strikeouts for the chance to hit home runs. “My willingness to fail is what gives me the ability to succeed,” the investor has said frequently.

The odds can be especially brutal in clean technology. The projects are often capital-intensive — like $200 million or more for a biofuels plant — and they can take years to pay out, said Sam Shelton, a research engineer at Georgia Institute of Technology. By comparison, social media start-ups often require little upfront money and few employees. “The economics are totally different,” Mr. Shelton said.

In part, Mr. Khosla aims to take stakes when the companies are still getting off the ground, rather than waiting until they’re more mature and more expensive. He first bought a stake in KiOR, which aims to convert wood chips to gas and diesel fuel, in 2007. The company is now completing the first of five planned plants in Mississippi with the help of a $75 million interest-free loan from the state.

Mr. Khosla is “always thinking at a very high level about the potential of an idea,” KiOR’s chief executive, Fred Cannon, said. “He has a very good feel for when to step on the gas.”

After jumping in early, Mr. Khosla appears willing to ride out the swings, in both directions. Over the years, public filings indicate he has plowed roughly $80 million into KiOR, amassing a 54 percent stake in the company. Although the stock is off its peak levels and I.P.O. investors are still underwater, his holdings are worth $356 million — a threefold gain.

California school districts face huge debt on risky bonds









Two hundred school districts across California have borrowed billions of dollars using a costly and risky form of financing that has saddled them with staggering debt, according to a Times analysis.


Schools and community colleges have turned increasingly to so-called capital appreciation bonds in the economic downturn, which depressed property values and made it harder for districts to raise money for new classrooms, auditoriums and sports facilities.


Unlike conventional shorter-term bonds that require payments to begin immediately, this type of borrowing lets districts postpone the start of payments for decades. Some districts are gambling the economic picture will improve in the decades ahead, with local tax collections increasingly enough to repay the notes.





DATABASE: Bonds by district


CABs, as the bonds are known, allow schools to borrow large sums without violating state or locally imposed caps on property taxes, at least in the short term. But the lengthy delays in repayment increase interest expenses, in some cases to as much as 10 or 20 times the amount borrowed.


The practice is controversial and has been banned in at least one state. In California, prominent government officials charged with watching the public purse are warning school districts to avoid the transactions.


One sounding the alarm is California Treasurer Bill Lockyer, who compares CABs to the sort of creative Wall Street financing that contributed to the housing bubble, the subsequent debt crisis and the nation's lingering economic malaise.


"They are terrible deals," Lockyer said. "The school boards and staffs that approved of these bonds should be voted out of office and fired."


Most school bonds, like home mortgages, require roughly $2 to $3 to be paid back for every $1 borrowed. But CABs compound interest for much longer periods, meaning repayment costs are often many times that of traditional school bonds.


And property owners — not the school system — are likely to be on the hook for bigger tax bills if the agency's revenues can't cover future bond payments, Lockyer and other critics say.


Several financial consultants who advise school districts on CABs declined to comment, as did the chairman of their trade group. Education officials acknowledge some drawbacks with CABs, but argue that the bonds are funding vital educational projects.


The Newport Mesa Unified School District in Orange County issued $83 million in long-term notes in May 2011. Principal and interest will total about $548 million, but officials say they are confident they can pay off the debt.


The bonds "have allowed us to provide for facilities that are needed now," said the district's business manager, Paul Reed. "We could not afford to wait another 10 years."


Overall, 200 school systems, roughly a fifth of the districts statewide, have borrowed more than $2.8 billion since 2007 using CABs with maturities longer than 25 years. They will have to pay back about $16.3 billion in principal and interest, or an average of 5.8 times the amount they borrowed.


Nearly 70% of the money borrowed involves extended 30- to 40-year notes, which will cost district taxpayers $13.1 billion, or about 6.6 times the amount borrowed on average.


State and county treasurers say debt payments of no more than four times principal are considered reasonable, though some recommend a more conservative limit of three times.


"This is part of the 'new' Wall Street," Lockyer said. "It has done this kind of thing on the private investor side for years, then the housing market and now its public entities."


The Poway Unified School District, which serves middle-class communities in north San Diego County, is one of the school systems faced with massive CAB debt payments. In 2011, it issued $105 million in capital appreciation bonds to complete a school rebuilding program.


Because the recession had depressed property values and tax revenue, Poway district officials realized that using conventional bonds might jeopardize a promise to district voters to limit the tax rate.


So on the advice of an Irvine-based financial consulting firm, they turned to the long-term notes. Under the deal, the school board could keep construction moving, avoid reneging on its pledge to voters and stay within the legal limits. And it would not have to repay the bonds for decades.

Mercedes Rolls Out the Future of the SUV











LOS ANGELES, California – Geländewagen. It’s not an Austrian insult or some obscure epithet from the Eastern Bloc; it’s Mercedes-Benz’ iconic SUV. Originally crafted with a ruler and a chisel for military use, it eventually went on sale to civilians in 1979 and hasn’t changed much during its 30-plus-year run. Until now.


Mercedes knows that the G-Wagon will have to be updated at some point, and the Ener-G-Force concept gives us an indication of what the crew from Stuttgart is thinking for its next big and brash ‘ute – in the year 2025.


Like its forebear, this new G was originally envisioned by its Advanced Design Studio in Carlsbad, California, to be the mother-truckin’ ride for the Highway Patrol, and then toned down for use by Hollywood soccer moms and oil-rich Middle Easterners.


The lines and proportions are inspired by the original G, with an upright fascia, bulging wheel arches (housing 20-inch wheels and ultra-all-terrain tires) and flat roof. The LED headlamps form a perfect “G” in a nod to the concept’s heritage and the faux spare wheel well on the hatch opens up and extends outward to reveal a safety kit, tool box and other assorted off-road survival equipment.


As for the powertrain, we’ll have whatever Mercedes’ design team is smoking. Individual electric motors power each wheel – not that far-fetched – but a “hydro-tech converter” fueled by recycled water stored on the roof is transformed into hydrogen, which powers the space-age G for a claimed 500 miles of emissions-free motoring.


Less sci-fi is the roof-mounted “Terra-Scan” 360-degree topography scanner, which tracks the terrain ahead and automatically adjusts the spring and damper rates of the suspension to provide a silky smooth ride no matter what you’re driving on. Mercedes is actually working on a stereo camera-based system for future models that does just that, but the chances of it coming to the G-Class are about as good as the Ener-G-Force ever reaching production.

“Anger Management,” “Justified” return dates set by FX












LOS ANGELES (TheWrap.com) – FX released its early 2013 premiere schedule Wednesday, including dates for the second season of Charlie Sheen‘s sitcom “Anger Management” and the fourth season of the Timothy Olyphant lawman drama “Justified.”


The premiere schedule kicks off with “Justified” on Tuesday, January 8 at 10 p.m. The season will find Olyphant’s character, U.S. Deputy Marshall Raylan Givens, picking up a 30-year-old cold case, unraveling a riddle that echoes all the way back to his boyhood and his criminal father’s bad dealings.












The premieres go into high gear on January 17, with the return of “Anger Management,” “Archer” and “Totally Biased W. Kamau Bell,” as well as the series premiere of the new offering “Legit.”


“Anger Management,” which received a 90-episode order after the success of its first season, will premiere with consecutive episodes at 9 and 9:30 p.m., with the animated series “Archer” premiering its fourth season at 10 p.m.


The new series “Legit,” which stars Jim Jeffries as a foul-mouthed Australian comedian struggling to legitimize his life and career in Los Angeles, will begin its 13-episode maiden season at 10 p.m., while “Totally Biased W. Kamau Bell,” which features comedian Bell riffing on politics, culture and other topics, will start a new cycle of episodes at 11 p.m.

Well: Weight Loss Surgery May Not Combat Diabetes Long-Term

Weight loss surgery, which in recent years has been seen as an increasingly attractive option for treating Type 2 diabetes, may not be as effective against the disease as it was initially thought to be, according to a new report. The study found that many obese Type 2 diabetics who undergo gastric bypass surgery do not experience a remission of their disease, and of those that do, about a third redevelop diabetes within five years of their operation.

The findings contrast with the growing perception that surgery is essentially a cure for Type II diabetes. Earlier this year, two widely publicized studies reported that surgery worked better than drugs, diet and exercise in causing a remission of Type 2 diabetes in overweight people whose blood sugar was out of control, leading some experts to call for greater use of surgery in treating the disease. But the studies were small and relatively short, lasting under two years.

The latest study, published in the journal Obesity Surgery, tracked thousands of diabetics who had gastric bypass surgery for more than a decade. It found that many people whose diabetes at first went away were likely to have it return. While weight regain is a common problem among those who undergo bariatric surgery, regaining lost weight did not appear to be the cause of diabetes relapse. Instead, the study found that people whose diabetes was most severe or in its later stages when they had surgery were more likely to have a relapse, regardless of whether they regained weight.

“Some people are under the impression that you have surgery and you’re cured,” said Dr. Vivian Fonseca, the president for medicine and science for the American Diabetes Association, who was not involved in the study. “There have been a lot of claims about how wonderful surgery is for diabetes, and I think this offers a more realistic picture.”

The findings suggest that weight loss surgery may be most effective for treating diabetes in those whose disease is not very advanced. “What we’re learning is that not all diabetic patients do as well as others,” said Dr. David E. Arterburn, the lead author of the study and an associate investigator at the Group Health Research Institute in Seattle. “Those who are early in diabetes seem to do the best, which makes a case for potentially earlier intervention.”

One of the strengths of the new study was that it involved thousands of patients enrolled in three large health plans in California and Minnesota, allowing detailed tracking over many years. All told, 4,434 adult diabetics were followed between 1995 and 2008. All were obese, and all underwent Roux-en-Y operations, the most popular type of gastric bypass procedure.

After surgery, about 68 percent of patients experienced a complete remission of their diabetes. But within five years, 35 percent of those patients had it return. Taken together, that means that most of the subjects in the study, about 56 percent — a figure that includes those whose disease never remitted — had no long-lasting remission of diabetes after surgery.

The researchers found that three factors were particularly good predictors of who was likely to have a relapse of diabetes. If patients, before surgery, had a relatively long duration of diabetes, had poor control of their blood sugar, or were taking insulin, then they were least likely to benefit from gastric bypass. A patient’s weight, either before or after surgery, was not correlated with their likelihood of remission or relapse.

In Type 2 diabetes, the beta cells that produce insulin in the pancreas tend to wear out as the disease progresses, which may explain why some people benefit less from surgery. “If someone is too far advanced in their diabetes, where their pancreas is frankly toward the latter stages of being able to produce insulin, then even after losing a bunch of weight their body may not be able to produce enough insulin to control their blood sugar,” Dr. Arterburn said.

Nonetheless, he said it might be the case that obese diabetics, even those whose disease is advanced, can still benefit from gastric surgery, at least as far as their quality of life and their risk factors for heart disease and other complications are concerned.

“It’s not a surefire cure for everyone,” he said. “But almost universally, patients lose weight after weight loss surgery, and that in and of itself may have so many health benefits.”

United Is Struggling Two Years After Its Merger With Continental

CHICAGO — It was supposed to be a moment for celebration: United Airlines observing the delivery of its second Boeing 787 Dreamliner with a flight from Seattle to Chicago earlier this month for a select group of employees, while senior officers, including Jeffery A. Smisek, United’s hard-charging chief executive, served Champagne and took lunch orders.

But before the flight took off that morning, a computer glitch in one of the airline’s computer systems delayed 250 flights around the world for two hours.


So it goes at United these days. The world’s biggest airline, created after United merged with Continental Airlines in 2010, promised an unparalleled global network, with eight major hubs and 5,500 daily flights serving nearly 400 destinations. As an added benefit, the new airline would be led by Mr. Smisek of Continental, which was known for its attention to customer service.


But two years on, United still grapples with a myriad problems in integrating the two airlines. The result has been hobbled operations, angry passengers and soured relations with employees.


The list of United’s troubles this year has been long. Its reservation system failed twice, shutting its Web site, disabling airport kiosks and stranding passengers as flights were delayed or canceled. The day of the 787 flight, another system, which records the aircraft’s weight once passengers and bags are loaded, shut down because of a programming error.


United has the worst operational record among the nation’s top 15 airlines. Its on-time arrival rate in the 12 months through September was just 77.5 percent — six percentage points below the industry average and 10 percentage points lower than Delta Air Lines. It had the highest rate of regularly delayed flights this summer, and generated more customer complaints than all other airlines combined in July, according to the Transportation Department.


The airline even angered the mayor of Houston, Continental’s longtime home and still the carrier’s biggest hub, when it unsuccessfully sought to block Southwest Airlines’ bid to bring international flights to the city’s smaller airport, Hobby. 


The United-Continental merger is weighing on the company’s finances. It took a $60 million charge in the third quarter for merger-related expenses, including repainting planes. It also took a $454 million charge to cover a future cash payment to pilots under a tentative deal reached in August.


While most large airlines reported profits this year, United has lost $103 million in the first three quarters of 2012, with revenue up just 1 percent to $28.5 billion. Its shares are up 7 percent this year compared with a 12 percent gain for the Standard & Poor’s 500-stock index and a 24 percent gain for Delta.


“United remains at a challenging point,” analysts from Barclays wrote last month, and they forecast that the carrier would not begin to see the benefits of its merger until late in 2013 and into 2014. Still, while airlines initially struggle, mergers increase revenue eventually, as the example of Delta’s acquisition of Northwest Airlines demonstrated two years ago.


Mr. Smisek, taking a break from serving coffee halfway through the maiden 787 flight, acknowledged that things were not going as fast as expected, particularly given the aggressive targets he set two years ago. Back then, Mr. Smisek said the merger would be wrapped up in 12 to 18 months. He has since learned to be patient, he said.


“It is still a work in progress,” he said. “The integration of two airlines takes years. It’s very complex. If you look at where we were two years ago, we’ve come a long way.”


Admittedly, the process is complicated. Airline mergers mean combining different technologies, often old computer systems, as well as thousands of procedures used by pilots and flight dispatchers, gate agents, flight attendants and ground crew.


Setbacks are common. Like United, US Airways experienced a breakdown in its booking technology after its combination with America West in 2005. Delta’s on-time performance fell sharply in the year after its purchase of Northwest.


But today, Delta is a leader among big airlines in on-time performance. US Airways had a record third-quarter profit even though it still lacks common work rules for its pilots seven years after its merger.


United has completed many of its merger tasks, particularly as far as passengers are concerned. It has received its single operating certificate from the Federal Aviation Administration, allowing it to run a combined fleet. Despite all the problems this summer, it claims to have finally merged the reservation and technology systems.

Alleged WikiLeaks source says he was illegally punished in jail









A key pretrial hearing for Pfc. Bradley Manning, accused of giving classified material to the website WikiLeaks, which then made it public, began Tuesday in a case that highlights the government’s resolve to keep war and diplomatic material secret.


Manning, who has been charged on 22 counts, faces life in prison if convicted of aiding the enemy, the most serious charge. His court-martial is scheduled for February.


A former intelligence analyst in Baghdad in 2009 and 2010, Manning is accused of sending hundreds of thousands of logs about the wars in Iraq and Afghanistan and more than 250,000 diplomatic cables to WikiLeaks.





The hearing at a military court at Ft. Meade outside Baltimore is scheduled to run through Sunday. Manning is expected to testify at some point. It would be the first time he has spoken publicly about the case and the conditions of his detainment since his arrest in 2010.


The defense will argue that all charges should be dismissed because Manning was subjected to “unlawful pretrial punishment,” according to a post on the website of his supporters, the Bradley Manning Support Network.


Manning will get a chance to testify about his treatment. His lawyers argue that he was illegally punished by being put alone in a cell for nine months at the Marine Corps brig in Quantico, Va. Military judges can dismiss all charges if pretrial punishment is particularly egregious, but that rarely happens, though the time in incarceration can be credited toward the sentencing.


“At this extremely important hearing, Bradley’s lawyer David Coombs ... will present evidence that brig psychiatrists opposed the decision to hold Bradley in solitary, and that brig commanders misled the public when they said that Bradley’s treatment was for ‘Prevention of Injury,' " his supporters said.


Manning has offered to take responsibility by pleading guilty to reduced charges. The military has not ruled on that offer.


Manning was in the brig from July 2010 to April 2011. The military argues the treatment there was proper since he classified as a maximum-security detainee. He was later moved to Ft. Leavenworth, Kan., where he was reevaluated and given a medium-security classification.


A United Nations investigator called the conditions of Manning's imprisonment cruel, inhuman and degrading, but stopped short of calling it torture.

Sprint, Chrysler Link Up With 'Velocity' In-Car System



The latest contender in the battle for your dashboard is Sprint’s Velocity, the telecommunications company’s first comprehensive in-car infotainment and telematics architecture aimed at automakers.


Sprint is unveiling Velocity this week at the Los Angeles Auto Show, which is billing itself as the place for hot new automotive tech introductions. Sprint’s lined up Chrysler as its first partner, and we got our hands on the all-new UConnect system featured in the Ram pickup truck and Dodge Viper. But the telecom plans to infiltrate the rest of Chrysler’s line-up and form partnerships with other automakers.


“Sprint Velocity is a whole new platform we built specifically for the automobile industry,” Tom Nelson, director of global wholesale and solutions marketing, told Wired. “It’s a global, end-to-end solution that simplifies the ability for manufacturers and consumers to connect devices to their cars.”


That’s a key development, because only about 4 percent of vehicles worldwide have the ability to connect with mobile devices that drivers bring into their cars. Machina Research expects that to hit 90 percent by 2020. Sprint wants a big piece of that pie.


What Velocity provides to automakers is the core technology on which to build infotainment and telematic systems. That includes remote locking and unlocking, vehicle start, 911 assist and creating a rolling Wi-Fi hotspot through an embedded modem or a tethered smartphone with a data connection. Infotainment and streaming music also is part of the puzzle, along with cloud-connected voice-activated controls for everything from navigation to texting.



Additionally, automakers are increasingly interested in getting information about customers’ cars for diagnostic and repair purposes, adding a more convenient connection between the automaker, the dealer and the driver.


“In the past, automakers had to stitch together all this stuff to create a connected technology in the vehicle,” says Nelson. With Sprint Velocity, “it’s an agile, adaptable and scalable platform.”


The scalability and — more importantly — upgradeability of an embedded system is of particular significance because the consumer electronics world moves at a much faster pace than the systems developed and deployed by automakers. One day you’ve got the latest and greatest in in-car connectivity; the next, you’re stuck with an outdated system that barely recognizes your shiny new smartphone or tablet.


Nelson insists Sprint Velocity is device-agnostic, although only two mobile operating systems came up during our conversation: iOS and Android. While Apple and Google’s operating systems dominate the mobile arena, being agnostic allows consumers to bring any device they choose into the car. That’s been an issue for every automaker trying to make a play in the connected-car space.


Further, we’re not hearing anything from Sprint about apps or courting developers, although when asked, there was mention of an SDK. However, that decision will be left to Sprint’s automotive partners to decide, as both security and safety concerns are paramount.


On the plus side for developers, having a new, standardized architecture underpinning a large swath of the automotive world would alleviate some issues about which platforms to focus on. They have to build apps for fewer operating systems, saving time and money.



While this all sounds impressive, it’s important to note that Sprint isn’t the first telecom to play the embedded telematics and infotainment game. Verizon has had a decades-long partnership with General Motors for its OnStar system, and Big Red recently acquired Hughes Telematics — a major player in the in-car connectivity space — to expand its footprint inside vehicles.


“[Sprint is] eager to play a bigger role in this segment as the telcos are looking for new growth segments in an increasingly flat market for traditional mobile phone services,” said Gartner automotive and mobility analyst Thilo Koslowski.


“The money opportunity for the automotive industry lies in providing unique customer experiences regarding consuming, creating, sharing and enriching digital content in the vehicle,” says Koslowski. “This can only be successful if the automotive industry embraces collaboration with technology companies like Sprint.”


But there’s a strong line between a partnership and ceding total control to an outside company, and automakers are intent on maintaining their own branding, ecosystems and user-interface designs. Automakers have to find their own space within these growing mobile ecosystems, and nobody – massive automakers or ambitious telecos – has cracked the code. Sprint Velocity is a step in that direction, but it all hinges on widespread adoption.

Judge bows out of ‘pink slime’ suit over ABC ties












SIOUX FALLS, S.D. (AP) — A federal judge has recused himself from presiding over a $ 1.2 billion defamation lawsuit against ABC because his daughter-in-law works as a producer on one of the network’s morning shows.


Judge Lawrence L. Piersol recused himself from hearing the defamation lawsuit filed by South Dakota-based Beef Products Inc. against ABC because his daughter-in-law works as a producer on “Good Morning America.”












The case has been reassigned to Chief Judge Karen Schreier.


Beef Products Inc. sued ABC in September over its coverage of a meat product called lean, finely textured beef. Critics have dubbed the product “pink slime.” The meat processor claims the network damaged the company by misleading consumers into believing the product is unhealthy and unsafe.

Global Update: Investing in Eyeglasses for Poor Would Boost International Economy

Eliminating the worldwide shortage of eyeglasses could cost up to $28 billion, but would add more than $200 billion to the global economy, according to a study published last month in the Bulletin of the World Health Organization.


The $28 billion would cover the cost of training 65,000 optometrists and equipping clinics where they could prescribe eyeglasses, which can now be mass-produced for as little as $2 a pair. The study was done by scientists from Australia and the Johns Hopkins Bloomberg School of Public Health.


The authors assumed that 703 million people worldwide have uncorrected nearsightedness or farsightedness severe enough to impair their work, and that 80 percent of them could be helped with off-the-rack glasses, which would need to be replaced every five years.


The biggest productivity savings from better vision would not be in very poor regions like Africa but in moderately poor countries where more people have factory jobs or trades like driving or running a sewing machine.


Without the equivalent of reading glasses, “lots of skilled crafts become very difficult after age 40 or 45,” said Kevin Frick, a Johns Hopkins health policy economist and study co-author. “You don’t want to be swinging a hammer if you can’t see the nail.”


If millions of schoolchildren who need glasses got them, the return on investment could be even greater, he said, but that would be in the future and was not calculated in this study.

A Struggling CNN Casts Its Eyes on Jeffrey Zucker


In the days to come, when Time Warner appoints a new leader of CNN Worldwide for the first time in a decade, that person will face an identity crisis unlike any other in corporate America.


Though CNN over all is on track to have its most profitable year ever, its flagship channel in the United States is seemingly rudderless, run by layers of producers and executives — many with competing visions. Its low prime-time ratings are the stuff of punch lines and a journalism school case study in the damage wrought by the digital age.


Then again, CNN also has tremendous potential, an enviably popular Web site and countless people rooting for it to succeed.


Throughout a four-month search for the person to succeed Jim Walton, the departing president, attention has centered on Jeffrey Zucker, the former chief executive of NBCUniversal, who was replaced when Comcast took over the company last year. Mr. Zucker produces Katie Couric’s syndicated daytime talk show.


Several news executives close to Mr. Zucker said this week that they believed he had been chosen to run CNN, and they expected the appointment to be announced soon. People close to the Time Warner chief executive, Jeffrey L. Bewkes, also identified Mr. Zucker. A Time Warner spokesman declined to comment.


In considering candidates to run one of the world’s best-known, but beleaguered, news organizations, Mr. Bewkes and his deputy Phil Kent have also been considering their own legacies. They are cautious about not undermining CNN’s journalistic heart and soul, even as they strive to resuscitate the channel’s prime-time lineup, according to people who have met with them about the search. That means the channel’s programming will remain nonpartisan in nature.


“They want someone who has programming and management and cable expertise; someone who can be credible to the staff and to the business community,” one person said. “They know that this is a pretty tall order.”


Mr. Zucker could check off all those boxes. As a young NBC News producer, he helped start what became a 16-year winning streak for the “Today” show. He had mixed results as he moved up the rungs of NBC, but he can point to cable programming successes even as the NBC broadcast network struggled. He did not respond to requests for comment, and people with knowledge of the search insisted on anonymity to preserve friendships and business relationships.


But many others in and around CNN spoke on the record about the challenges ahead. Getting the top-heavy 4,000-person company — spread among New York, Washington, Atlanta and bureaus around the world — to row in the same direction will be one of the toughest tasks, many said.


CNN’s many channels and sites net roughly $600 million in annual profits, through advertising revenue and subscriber fees. But the channel is leaving ad dollars on the table, as one executive put it, because its prime-time ratings are lagging, and it is putting future fee increases at risk by appearing irrelevant in the eyes of some cable subscribers.


One problem dates back to CNN’s creation in 1980: when there is a lack of news, there is a lack of viewers. Kiran Chetry, a CNN morning anchor from 2007 to 2011, said her time there was like being on a news treadmill: “We were running, sweating, doing the work, but never getting anywhere ratings-wise,” she said. This stemmed, she said, from uncertainty about “what we were, who our audience was and how we best served them.”


As Fox News and, later, MSNBC put on confrontational political programs with partisan points of view, CNN sold itself as proudly nonpartisan, but it fell from first to second to third place in the cable news wars along the way. This should have been an “up” year for the channel, thanks to the presidential election; but through mid-November the channel had drawn 412,000 viewers at any given time, down 16 percent from the previous 12 months.

Congress returns as 'fiscal cliff' talks slow









WASHINGTON – Congress returned in a lame duck session with no signs of quick compromise to prevent a tax hike for most Americans early next year.


Talks between the White House and Republican leaders in the House continued behind closed doors. Current tax rates expire Dec. 31.


Emboldened by his re-election, President Obama took his case for raising taxes on the wealthiest Americans to the public on Monday. He warned that the threat of higher taxes on middle-class Americans could dampen the Christmas shopping season.





"The President has called on Congress to take action and stop holding the middle class and our economy hostage over a disagreement on tax cuts for households with incomes over $250,000 per year," the White House said in a statement.

The White House got a boost from billionaire investor Warren Buffett, who said the wealthy – himself included – should pay more. Noting the nation’s growing gap in income disparity, Buffett dismissed the Republican argument that tax hikes would hamper investments.


“In recent years, my gang has been leaving the middle class in the dust,” Buffett said. “So let’s forget about the rich and ultrarich going on strike and stuffing their ample funds under their mattresses if — gasp — capital gains rates and ordinary income rates are increased.”


Key Republicans, including House Speaker John A. Boehner, have signaled they are willing to put new tax revenues on the table, creating the outlines of a possible deal. Several Republican lawmakers used the Sunday talk shows to distance themselves from their party’s anti-tax pledge, publicly breaking with conservative stalwart Grover Norquist, although they insisted any agreement must include spending cuts.


A so-called grand bargain of tax hikes and spending cuts has eluded Washington in the past, but both political parties are wary of rattling the financial markets and sparking a crisis in consumer spending. Wall Street has signaled a bold deficit-reduction plan is needed to prevent a credit downgrade.

No talks between the president and congressional leaders have been scheduled. The parties had agreed to meet this week to put the framework of a two-part deal on the table.


If Republicans continue to fight higher tax rates for the wealthy, Boehner will face pressure to propose an alternative way to raise new revenue – either by closing individual loopholes or capping deductions in a way that produces new money.


“Congressional and White House staff continue to work to find common ground that is consistent with the ‘balanced approach’ the White House says it wants – with significant spending cuts, and without job-killing small business tax hikes,” said a senior House leadership aide.
